KV33 Swell Terms & Conditions

By registering for programs, donating, or communicating with KV33 Swell, you agree to the following Terms & Conditions.

1. Participation & Assumption of Risk

Participation in surfskate, movement, and sound immersion activities involves inherent physical risks. By participating (or allowing your child to participate), you acknowledge and accept these risks.

Participants must follow all safety instructions and guidelines.

2. Waivers & Releases

All participants (or guardians) must complete required waivers prior to participation. Failure to complete waivers may result in removal from programs.

3. Program Changes

KV33 Swell reserves the right to:

  • Modify schedules, locations, or instructors

  • Cancel or reschedule programs due to weather, safety, or unforeseen circumstances

4. Payments & Donations

  • Donations are tax-deductible to the extent allowed by law

  • Program fees are non-refundable unless otherwise stated

  • KV33 Swell is a registered 501(c)(3) nonprofit organization

5. Communications Consent

By providing your email or phone number, you consent to receive communications related to:

  • Program updates

  • Scheduling

  • Nonprofit announcements

SMS consent is optional and may be withdrawn at any time by replying STOP.

6. Media Release

Unless otherwise stated in writing, participants grant KV33 Swell permission to use approved photos or videos for nonprofit purposes.

7. Code of Conduct

KV33 Swell maintains a respectful, inclusive environment. We reserve the right to remove participants or guardians who engage in unsafe, disruptive, or inappropriate behavior.

8. Limitation of Liability

KV33 Swell is not liable for:

  • Personal injury

  • Lost or damaged personal property

  • Events beyond our reasonable control

9. Governing Law

These Terms & Conditions are governed by the laws of the State of Texas.
